The petitioners have been implicated in connection with Dhaniakhali Police Station Case No. 186 of 2017 wherein chargesheet was submitted under Sections 447//323/324/354/379/427/34 of the Indian Penal Code. Learned advocate for the petitioners expresses their anxiety regarding the progress of the trial of the case as repeated adjournments have been granted.
As none appears on behalf of the State, Mr. Koushik Kundu, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. His appointment may be regularized by the concerned authorities in due course. Learned advocate for the petitioner is directed to serve a copy of the revisional application upon Mr. Kundu, learned advocate appearing for the State.
I have considered the period of pendency of the present case and on an appreciation of the order so passed, I am of the opinion that the anxiety expressed by the petitioners is justified. Having regard to the contentions so advanced, I direct the learned Judicial Magistrate, 5th Court, Hooghly to fix at least one date in connection with the present case on each and every 60 days so that trial of the case would be concluded within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties. All materials, exhibits and documents may be placed on the date so fixed for evidence. Efforts must be taken by all the stakeholders so that the trial is concluded at the earliest.
With the aforesaid observations, the present revisional application being CRR 2477 of 2022 is disposed of. All Pending applications, if any, are disposed of accordingly.
