I have heard learned counsel appearing on behalf of the parties and perused the materials placed on record. The District Magistrate, being the respondent No. 3 is directed to consider the representation dated September 22, 2021 upon giving an opportunity of hearing to the petitioner and pass a reasoned order in the light of the prevailing notification dated August 07, 2012 within a period of six weeks from date. The reasoned order should be communicated to the petitioner within a period of two weeks from the date of passing of the same.

Needless to mention if the reasoned order is in favour of the petitioner, the authorities are directed to act in accordance with law.

With the aforesaid direction, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
