Dey ..for the State The state respondents hand over a copy of the order issued by the Block Development Officer, Chanditala-I Development Block dated October 28, 2021. The order indicates that a four men committee has been constituted to look into the grievance of the petitioners. The committee has been asked to furnish a report indicating whether the land on which the mobile tower is being proposed to be constructed, falls within 100 meters radius of any residential building, school or hospital.

The committee has been also directed to indicate whether the installation of mobile tower was in contravention to the West Bengal Telecom Infrastructure Guidelines, 2020 or not.

Under such circumstances, at this stage, this Court is of the view that the grievance of the petitioners have been addressed.

Upon receipt of the report from the four men committee, further steps and directions shall be

issued by the Block Development Officer. The principles of natural justice will be followed. This Court has not gone into the merits of the allegation of the petitioner.

This Court has not expressed any opinion with regard to the alleged mobile tower.

All the issues shall be decided in accordance with law.

The entire exercise shall be completed within a period of six months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
