In Re: An Application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure, 1973. This revisional application was preferred challenging the order dated 23.03.2012 passed by learned Additional Sessions Judge, Fast Track Court, Mal, Jalpaiguri in connection with Sessions Case No. 130 of 2007 arising out of Mal Police Station Case No. 72 of 2003 dated 16.05.2003. The grievance of the petitioner was rejection of an application under Section 311 of the Code of Criminal Procedure for recalling two of the witnesses for further crossexamination after the evidence of the witnesses were closed. The learned trial Judge, on consideration of the submissions and the relevant materials appearing before him, was pleased to dismiss the prayer so advanced by the petitioner.
The records of this revisional application reflects that the revisional application till date has not been admitted. No information has been furnished before this Court regarding the present stage of the case after nine years. As such, there is no scope for interfering at this belated stage. Thus, the revisional application being CRR 2179 of 2012 is dismissed.
All pending connected applications, if any, are consequently disposed of.
