Mr. Anjan Bhattacharya ........for the petitioner Mr. Sourav Mitra ......for the WBCSSC Mr. Pinaki Dhole Mr. Pinaki Bhattacharya .....for the State Pursuant to the order dated 2nd September, 2024, report in the form of affidavit is filed on behalf of the District Inspector of Schools (SE), Uttar Dinajpur, which was affirmed on 19th September, 2024. Same is taken on record.

On perusal of the said report, it appears that at present roll strength of the concerned school is 2,245 whereas 24 teachers are working there meaning thereby Pupil-Teacher Ratio is 1:94.

Petitioner has prayed for transfer on the ground of distance where in terms of the relevant provisions of Transfer Rules as amended from time to time Pupil-Teacher Ratio

is relevant consideration in entertaining such transfer application.

Since the present Pupil-Teacher Ratio as indicated in paragraph 6 of the report does not permit transfer of petitioner on the ground of distance, no relief can be granted to the petitioner.

Accordingly, writ petition stands dismissed.

However, this order shall not preclude the petitioner to apply for transfer in accordance with law in future in the event Pupil-Teacher Ratio permits transfer of petitioner on the ground of distance.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
