Heard the learned counsels for the parties.

The grievance of the petitioners is that the private respondents are raising construction on P.W.D Road by blocking the egress and ingress of the petitioners. The petitioners submitted a representation before the Junior Engineer, Nalhati Highways Section, P.W. (Roads) Department, Nalhati, Birbhum on 21st September, 2021 ventilating their grievance, but the said representation is yet to be disposed of. It is submitted by the private respondents that no such construction is being raised on P.W.D's land and the allegation of the petitioners is out and out false.

The State respondents pray for disposal of the representation filed by the petitioners by the concerned authority.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition by directing the sixth respondent to take necessary steps for consideration and disposal of the representation filed by the petitioners dated 21st September, 2021 within a period of three months from the date of communication of this order, after affording reasonable opportunity of hearing to all the interested parties including the petitioners and the private respondents, in accordance with law.

With the aforesaid observations and directions, WPA 16085 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit has been invited, the allegations contained in the petition are deemed not to be admitted.
