WPA 15017 of 2025 (Prasenjit Guria vs. State of West Bengal & Ors.) Mr. Chittapriya Ghosh Ms. Priyanka Saha .... For the Petitioner Mr. Kamal Mishra .... For the Respondent Affidavit of service filed on behalf of the petitioner is taken on record.

None appears for the State and the Panchayat despite service.

The grievance of the petitioner is twofold:

First, encroachment of his land by the private respondents.

Second, illegal/unauthorised construction being raised by them without obtaining sanctioned plan. The allegation of the petitioner with regard to the alleged encroachment of his land shall be dealt with by the learned civil Court. With regard to the alleged unauthorised construction by the private respondents without obtaining sanctioned plan, on prayer of the petitioner liberty is granted to submit a comprehensive representation before the Pradhan, Kalagachia Anchal no. 6 Gram Panchayat, being the 7th respondent herein, within 7 days from date. The 7th respondent is directed to consider and dispose of the representation within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken

shall be communicated to the parties within a week thereof. In the event the construction allegedly raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps, in accordance with law.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
