C.R.M. (NDPS) 838 OF 2025 In Re : An application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in connection with Nabagram Police Station Case No. 352 of 2024 dated 23.07.2024 under Sections 20(b)/29 of the NDPS Act in NDPS case No. 60 of 2024.

And In the matter of : Kartik Pally @ Kartick Pally. .... Petitioner Mr. Kazi Rahman .... For the petitioner Mr. Koushik Kundu, Ms. Suchismita Dutta ... for the State 144 k.g. ganja was recovered from the pickup van of the present petitioner while he was in the driver's seat. Petitioner submits that investigation has already been culminated in a charge sheet on 15th February, 2025 and he is in custody for more than one year i.e. from 23rd July, 2024. He further submits that prosecution proposes to examine seventeen witnesses, out of which they could so far examineonly three witnesses and the next date is fixed in the month of December, 2025 and as such nobody knows when the trial would be concluded and considering his period of incarceration he may be released on bail on any terms and conditions. Learned counsel appearing on behalf of the State opposed the bail prayer contending that commercial quantity of narcotic

substance was recovered from the possession of the petitioner and the trial is in progress and if at this stage he is released on bail there is chance of his abscondance.

Having heard the learned counsel appearing on behalf of the petitioner and the State and that the restrictions imposed in Section 37 of the NDPS Act clearly attracts in respect of the present petitioner, his prayer for bail is considered and rejected. CRM (NDPS) 838 of 2025 stands disposed of.

Trial court is requested to expedite the trial and to come to a logical conclusion at the earliest.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
