The petitioners are the defendants Nos.1 and 2 in Title Suit No.60 of 2023, which is pending before the learned Civil Judge (Senior Division), 1st Court, Barasat. The petitioners pray for expeditious disposal of the application for injunction. It is submitted that written objection to the said application has been filed. It is also submitted that written statement has been filed. Apart from the application for injunction, an application for local inspection has also been filed.

An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite parties is not required. The prayer is innocuous.

Considering the nature of prayer, this Court directs the learned court below to dispose of the application for injunction and the application for local inspection within a period of

three months from the next date fixed, strictly in accordance with law and independently. Thereafter, the learned court below shall proceed with the expeditious disposal of the suit. This Court has neither gone into the merits of the suit nor gone into the merits of application.

A copy of the revisional application along with a server copy of this order be served upon the opposite parties within a week.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
