18.07.2022 Ct. No. 29 KAUSHIK REJECTED C.R.M.(A) 3399 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Nandakumar Police Station Case No. 09 of 2022 dated 08.01.2022 under Sections 302/34 of the Indian Penal Code, 1860.

And In Re : Biswajit Dolai @ Biswajit Dolui @ Bishwajit Dolai & Ors. ...... petitioners Mr. Sourav Chatterjee Mr. Avik Ghatak Mr. Fahad Imam ....for the petitioners Mr. Neiguive Ahmed Mr. Iqbal Kabir ....for the State Petitioners pray for anticipatory bail.

Learned advocate appearing for the petitioners submits that, there are no materials implicating any of the petitioners. The police filed charge-sheet and, therefore, custodial interrogation of the petitioners are not required. Learned advocate appearing for the State draws the attention of the Court to the First Information Report and the statement of the eye witness recorded under Section 161 of the Code of Criminal Procedure (Cr.P.C.). He submits that, all the petitioners are involved in the murder of the victim.

Considering the post mortem report of the victim, the 161 Cr.P.C. statement and the other materials in the case diary, we are unable to enlarge any of the petitioners on anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM (A) 3399 of 2022 is dismissed.
