This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), First at Hooghly, to dispose of the Title Suit No.309 of 2009 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned Trial Judge.

From the order-sheets appended to this application, this Court finds that June 27, 2025 was fixed for evidence of the defence witness no.3 and for payment of cost.

The learned counsel appearing for the petitioner submits that on June 27, 2025, the defendant/opposite party prayed for an adjournment

and such prayer for adjournment was allowed subject to payment of cost. He further submits that the next date has been fixed on July 14, 2025.

In the light of the submission made by the petitioner, C.O. 2408 of 2025 stands disposed of with hope and trust that the learned Civil Judge (Junior Division), First at Hooghly shall make an endeavour to dispose of the Title Suit No.309 of 2009 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
