1. The learned counsel appearing for the plaintiff/appellant has submitted on instruction that during pendency of the appeal the parties have amicably settled their disputes out of court and the appellant is not willing to proceed with the appeal.

2. The learned counsel for the respondent No.1 has also submitted that the matters have been amicably settled between the parties.

3. In view thereof, the appeal is dismissed for nonprosecution by recording that the parties have amicably settled their disputes out of court.

4. Prayer is made for dismissal of the related suit pending before the Alipore Court for non-prosecution.

5. Leave is given to mention before the appropriate court with the same prayer.

6. Accordingly, the pending applications are also dismissed.
