Learned advocate for the petitioners submits that the present case was instituted challenging the continuance of Amherst Street Police Station Case No. 343 of 2016 dated 25.10.2016 wherein on conclusion of investigation chargesheet was submitted before the jurisdictional court.
Records reflect that in this case Investigating Agency on conclusion of investigation submitted chargesheet against the present petitioner under Sections 506/509/114 of the Indian Penal Code.
Learned advocate for the petitioners submitted that during the pendency of the revisional application charge has already been framed and examination of the witnesses have commenced. Having considered the stage at which sessions trial has reached, I am of the view that the petitioners would be at liberty to take the points canvassed in the present revisional application in course of the trial and at the stage of final argument of the case. This court after the evidence has commenced is not inclined to
interfere regarding the merits of the case. The learned trial court at the relevant stage of final argument would consider the merits on the available evidence without being influenced by any observations made by this court while disposing of the present revisional application.
With the aforesaid observations, the present revisional application being CRR 2488 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
