The writ petition is disposed of granting liberty to the petitioner to approach the appellate authority under Section 126 of the Electricity Act, 2003, in accordance with law. The issue of limitation raised by the CESC Ltd. shall be decided in the said proceeding to be filed by the petitioner.

A photocopy of the final order of assessment be handed over to Mr. Halder, learned Advocate appearing for the petitioner, here and now, to enable the petitioner to file the appeal.

For restoration of supply of electricity which was disconnected on detection of theft, the entire assessed amount

has to be paid without prejudice. The petitioner does not want to pay the amount.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
