28.07.2025 W.P.A. 15145 of 2025 Item No.46 Ct. No.35 dc.

Tathagata Nath versus The State of West Bengal & Ors.

Mr. Mrityunjoy Chatterjee, Mr. S. Chakraborty ... For the Petitioner.

Ms. Sumita Shaw, Mr. Soumen Chatterjee ... For the State.

Affidavit-of-service filed in Court today be kept with the record.

Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

The petitioner is aggrieved by the fact that certain false information is being pasted at different places in and around the locality where the petitioner is a resident. To that effect, information was furnished before the police authorities, but no steps have been taken.

State has submitted a report which reflects that initially Sankrail Police Station Case No. 55 of dated 22.01.2025 was registered for investigation on the basis of specific information received.

Subsequently again Sankrail Police Station Case No. 67 of 2025 dated 28.01.2025 was registered for investigation. So far as the accusation of the present petitioner is concerned, according to the nature of the accusation, prima facie, police

authorities are of the opinion that no cognizable offence has been made out and the information has been furnished for the purpose of shielding the criminal cases which have been registered.

Be that as it may, since the petitioner has informed the police authorities and police authorities have come to their opinion that no offence primarily seem to be made out and is a counteraction of the petitioner, pursuant to the criminal cases which were registered, I am of the view that if the petitioner is of opinion that he has materials in his possession to suggest that any offence is made out, petitioner would approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess and ascertain regarding the accusations and thereafter pass necessary directions.

With the aforesaid observations, the writ petition being WPA 15145 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
