18.07.2022 sdas rejected C.R.M.(DB) No. 2353 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Krishnagar Kotwali Police Station Case No. 378 of 2020 dated 15.06.2020 under Sections 326/307 of the Indian Penal Code subsequently added Section 302 of the Indian Penal Code.
And In Re : Parvati Roy @ Parbati Roy ..... petitioner Mr. Prabir Majumder Mr. Snehansu Majumder ... for the petitioner Mr. Swapan Banerjee Mr. Anindya Sunder Chatterjee ... for the State Petitioner renews her prayer for bail.
Learned Counsel appearing for the petitioner submits that there is little progress in the matter since last rejection of bail by this Court.
Learned Counsel appearing for the State opposes the prayer for bail. He submits that date has been fixed for recording evidence.
We have considered the materials on record. Statements of witnesses show that the petitioner had administered deleterious substance in the mouth of the minor and as a result, the child expired.
In view of the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected. We direct the trial court to expedite the trial and conclude the same at an early date without granting any unnecessary adjournment to either of the parties. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
