For the State It is submitted on behalf of the petitioner that the petitioner's land has been utilised by the West Bengal Highway Development Corporation Limited for extension of State highway without due process of law and the land has neither been acquired, nor any compensation been paid to the petitioner for the same.

Learned counsel for the State submits that the representation to that effect may be made before the third respondent who is the Managing Director, West Bengal Highway Development Corporation Ltd.

The representation shall be considered within a short period of time.

Upon consideration of the submissions made on behalf of the parties, the writ petition is disposed of with liberty to the petitioner to submit a representation stating the entire fact before the third respondent within a week from date. The third respondent is directed to consider and dispose of the said representation within two months from the date of receipt thereof after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

W.P.A. 16188 of 2021 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
