Tanyeer Sabiba Boksh v. State Of West Bengal And ORS.
03.07.2023
IN THE HIGH COURT AT CALCUTTA
Item No.133 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.
C.R.R. 2362 of 2023 In the matter of : Tanyeer Sabiba Boksh ... Petitioner.
Mr. Debajyoti Deb, Mr. Bijan Kumar Mondal, Ms. S. Parekh ... For the Petitioner.
Mr. Neguive Ahmed, Ms. Trina Mitra ... For the State.
Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Ms. Trina Mitra, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.
I have considered the plight of the complainant of the case who submits that the learned trial court after framing of the charges on May 2023 has been pleased to fix a date in the month of November 2023. Having regard to the plight expressed by the petitioner who initiated the case in the year 2020, I am of the view that the same is not unfounded. However, the learned trial court would see that schedule of same nature of three dates be fixed, but the same be fixed once in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and the learned public prosecutor conducting the case would on the date so fixed produce the materials, exhibits and evidence.
All stakeholders should cooperate with the learned trial court to conclude the trial at the earliest.
With the aforesaid observations, the revisional application being CRR 2362 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
