Momtaj Khatun v. State Of West Bengal And ANR
AD 449 August 20, 2025 Ct. 28 SG CRR 2926 of 2025 In the matter of:
Momtaj Khatun ... petitioner Mr. Sudip Das ... for the petitioner Learned counsel for the petitioner submits that the petitioner was granted maintenance allowance under Section 125 of the Code, but the husband, who is a Group-I officer of the State Government, has not paid anything. Rs.18 lakhs and odd is due. Execution cases are pending and have not been disposed of. It does not appear that the petitioner has challenged any order or even prayed for expeditious hearing of the execution cases. The question posed in prayer portion is rhetorical. Be that as it may, the revisional application is disposed of by granting liberty to the petitioner to take appropriate steps before the learned trial court and the learned executing courts, so that she is able to secure her rights under the statutory provisions and as ordered by competent Court of Law.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
