Learned advocate for the petitioner is aggrieved by the manner in which Chandannagore P. S. Case No. 65 of 2020 dated 09.08.2020 under Section 21(c) of the NDPS Act is progressing, as according to the learned advocate for the petitioner only two witnesses out of 14 witnesses till date have been examined. As none appears on behalf of the State, Mr. N. P. Agarwala, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. His appointment may be regularized by the concerned authorities in due course. Learned advocate for the petitioner is directed to serve a copy of the revisional application upon Mr. Agarwala, learned advocate appearing for the State.

The petitioner is in custody since August, 2020 i.e., for two years and ten months.

The learned trial court at this stage has to progress with the

speed of the trial and on and from the next date the learned trial court as such would fix a schedule of at least three dates and such schedule of three dates should be fixed once in every forty-five days. The learned Public Prosecutor conducting the case would ensure regarding the availability of the documents and the material exhibits at the time when the witnesses are examined. The learned special court is directed that in case any witness of the Government Department is absent on the dates so fixed immediately communications should be made to the Commissioner of Police/Superintendent of Police so concerned. Effective steps must be taken for concluding the trial at the earliest. With the aforesaid observations, the present revisional application being CRR 2499 of 2022 is disposed of. All Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
