Commercial quantity of phensedyl was allegedly recovered from the joint possession of this petitioner and the co-accused. He says that he is in custody for a considerable period of time. No substantial progress in the trial has been made. He prays for bail.

The State says that July 10, 2024 has been fixed as date for consideration of charges. There is sufficient incriminating evidence against the petitioner. All efforts will be made to expedite the trial.

In view of commercial quantity of contraband items being involved and keeping in mind the restrictions of Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail, at this stage.

The application for bail being CRM (NDPS) 1002 of 2024 is, thus, dismissed.

However, we request the learned trial Court to expedite the trial to the extent possible and to conclude the same as early as the business of the court may permit Signed By :
