Ms. Manika Sarkar ....for the petitioner Mr. Debabrata Saha Roy Mr. Arka Kumar Nag ..for the Corporation The learned advocate for the petitioner submits that the authorities of the Bidhan Nagar Municipal Corporation have not disposed of the application dated June 20, 2016 for mutation of the name of the petitioner in respect of the alleged plots in question. The petitioner claims to be the owner of lands measuring about12 Cottahs 3 Chhataks 14 sq.ft. in 5 plot nos. under Mouza Hatiara, J.L. No.14, L.R. Khatian No.1016, pertaining to L.R.Dag Nos.

211,212, 214,215 and 216.

Under such circumstances, this writ petition is disposed of with a direction upon the Commissioner, Bidhan Nagar Municipal Corporation to consider the application for mutation filed by the petitioner and pass a reasoned order by considering the representation dated August 25, 2017. A hearing shall be given to the petitioner. If it is found that the petitioner did not satisfy the conditions for mutation,

then the non-compliances shall be communicated to the petitioner with reasons. The mutation shall be granted if permissible under the law upon compliance of all formalities. While hearing the petitioner, the Corporation authorities shall also grant hearing to any person, who may have raised objections or may be connected with the aforementioned plots in question. A reasoned order shall be passed and communicated to all concerned. The entire exercise shall be completed within three months from communication of this order.

The writ petition is, thus, disposed of.

There will be, however, no order as to costs. Parties are directed to act on the server copy of this order.
