The present writ application has been preferred praying for appointment on compassionate ground due to premature retirement of his father who was a permanent employee with the respondent-Municipality.
It is submitted by the learned counsel for the petitioner that inspite of making the necessary application and complying with all the formalities as directed by the Municipality, there has been serious in action on the part of the Municipality in considering the petitioner's application which is in accordance with law.
It appears that the petitioner has completed all the formalities since the year 2014, but till date there has been no action on the part of the Municipality. On being served the Municipality has not appeared.
The State is being represented.
Accordingly, considering the materials on record and on hearing the learned counsels present, the writ application is disposed of with the direction that the respondent Nos. 2 and 3 shall consider the prayer of the petitioner made by way of an application and also by filling up the requisite format within 60 (sixty) days from the date of communication of this order.
The said matter shall be considered by giving an opportunity of hearing to the petitioner and also considering the relevant provision of law and pass a reasoned order by the respondent Nos. 2 and 3. Accordingly, WPA 13014 of stands disposed of.
Learned counsel for the petitioner and the State are at liberty to communicate a server copy of this order to the respondent Nos. 2 and 3 for immediate compliance. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Shampa Dutt (Paul), J.)
