28-06-2024 (ct. no.28) debajyoti (rejected) CRM (NDPS) 1001 of 2024 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliganj Police Station Case No.404 of 2023 dated 02-07-2023 under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act.

Approximately 2 kgs. Of Morphine (much above commercial quantity) was allegedly recovered from the possession of this petitioner. He says that he is in custody for 1 year 8 days. No substantial progress in the trial has been made. He prays for bail.

The State says that 1 out 14 witnesses has already been examined. There is sufficient incriminating evidence against the petitioner. All efforts will be made to expedite the trial.

In view of commercial quantity of contraband items being involved and keeping in mind the restrictions of Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail, at this stage.

The application for bail being CRM (NDPS) 1001 of 2024 is, thus, dismissed.

However, we request the learned trial Court to expedite the trial to the extent possible and to conclude the same as early as the business of the court may permit Signed By :
