The petitioner no. 1 is the wife of one Apu Ruidas and the petitioner nos. 2 and 3 are the parents of Apu Ruidas.

The grievance of the petitioners is that the police took Apu Ruidas in custody without any memo of arrest. The petitioners are not aware as to why Apu Ruidas has been arrested. The whereabouts of Apu Ruidas are also not made known to the petitioners. The petitioner nos. 2 and 3 have sustained injury while preventing arrest of Apu Ruidas. The petitioner no. 1 is the mother of 1 year 5 months old girl child. The petitioners pray for a direction upon the police not to take any coercive steps against them and to divulge the whereabouts of Apu Ruidas.

Learned advocate appearing on behalf of the State respondents relies upon the instruction forwarded by the Officer-in-Charge, Pandaveswar Police Station wherefrom it appears that the said Apu Ruidas was arrested in connection with the Pandaveswar Police Station FIR No. 87/24 dated 17th June, 2024 under Sections 498A/323/307/406/354/506/34 IPC.

A detailed complaint was lodged by one Sheuli Ruidas wife of late Tapas Ruidas against the petitioners and Apu Ruidas relying on which the arrest of Apu Ruidas was made. Apu Ruidas was forwarded and produced before the Learned Additional Chief Judicial Magistrate on 19th June, 2024 and he is in police custody.

As it appears from the submissions made on behalf of the parties that the said Apu Ruidas has been arrested in connection with a case registered before the Pandaveswar Police Station and is still in police custody, accordingly, it will be open for the petitioners to take appropriate steps before the Learned Trial Court for redressal of their grievances, if so advised. The writ petition stands disposed of.
