For the Petitioner It is submitted on behalf of the petitioner that the petitioner was granted bail in the present matter being Special Case no. 47 of 2004 under Section 39(1)(a) of the Indian Electricity Act read with Section 379 of the Indian Penal Code pending before the learned Judge, Special Court, Malda and the entire provisional amount was deposited by the petitioner at that time. The petitioner was under the impression that the case was dropped for which he did not appear before the learned trial Court on several dates for which warrant of arrest was issued against him on 13th March, 2009.

The petitioner undertakes to surrender before the learned trial Court within a fortnight from date. In view of the above, the revisional application is disposed of directing the petitioner to surrender before the learned trial Court within a fortnight from date. The learned trial Court shall consider the prayer for bail of the petitioner, in accordance with law. In the event, the petitioner fails to surrender before the learned trial Court

within the stipulated time frame, the learned trial Court shall be at liberty to take necessary steps, in accordance with law.

The warrant of arrest initially issued vide order passed on 13th March, 2009 and reissued on 28th February, 2023 be stayed till 16th August, 2024. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
