The petitioner's grievance is that the said electricity connection has not yet been provided.

Learned counsel appearing for WBSEDCL submits that, in order to effect the electricity connection at the petitioner's premises, installation of a total of four electricity poles was required. While three poles have been successfully installed, the installation of the fourth pole was objected to by respondent no. 4, who claims ownership over the land where the said pole was to be erected. In view of this dispute, the electricity connection could not be effected in favour of the petitioner.

Respondent no. 4 is not represented before this Court. Having considered the facts and circumstances, I find no justification to keep the present writ petition pending.

In light of the aforesaid dispute, WBSEDCL is directed to approach the concerned District Magistrate in terms of Rule 3(b) of the Works of Licensees Rules, 2006. Upon being approached, the District Magistrate shall adjudicate the issue after affording an opportunity of hearing to all concerned parties and shall pass a reasoned order within a period of three months from the date of such reference. A copy of the said order shall thereafter be duly communicated to all parties.

Accordingly, WPA 15171 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
