1. Petitioner contends he is not the principal accused. He renews his bail prayer.

2. Learned advocate for the State submits 18 out of 27 witnesses have been examined.

3. We have considered the materials on record. Statements of witnesses show petitioner and others were present as a group at the place of occurrence. Some of them had assaulted the victim resulting in the death of 2 persons. Bail prayer of co-accused Jahangir Sk. was turned down in March 2024.

4. In view of aforesaid incriminating circumstances, as trial has substantially progressed and offences, if proved, would attract mandatory life imprisonment. We are not inclined to grant bail to the petitioner.

5. The application for bail, is thus rejected.

6. We request the trial Court to conduct the trial on a day-to-day basis and conclude the same at an early dater preferably within one year from the date fixed for recording of evidence without granting unnecessary adjournments to either of the parties.
