Learned advocate appearing for West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that due to objection from respondent nos. 4 & 5, who are the relatives of the petitioner, the electricity connection could not be effected.

It appears that for effecting the proposed electricity connection, a pathway is required to be utilised. While the petitioner contends that the said pathway is made for common use of the petitioner and respondent nos. 4 & 5, the latter claim exclusive ownership of the pathway. Learned advocate appearing for respondent nos. 4 & 5 submits that the petitioner cannot be allowed to utilise their land for the purpose of giving the electricity connection.

In view of the aforesaid disputes, I deem fit and proper to direct WBSEDCL to approach the concerned District Magistrate in terms of Rule 3 (b) of the Works of Licensees Rules, 2006 within a period of three weeks from date. The concerned District Magistrate shall decide the issue within a period of three months thereafter after giving an opportunity of hearing to all concerned and a reasoned order shall be communicated to the parties.

Accordingly, WPA 15183 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
