This matter appeared in the Warning List of 29th November, 2022 with a clear indication that this matter shall be transferred to the Regular Bench on 5th December, 2022. Since then the matter is appearing in the list. The second appeal is of the year 1997. The appellant has due notice of the matter.
Earlier the administrative notice issued upon the sole appellant was served. In spite thereof, the appellant is not represented.
The appellate decree dated 11th April, 1997 affirming the judgment and decree dated 19th April, 1988 in a suit for declaration of title and possession is a subject matter of the second appeal. The suit was dismissed on contest. The First Appellate Court affirmed the said order. We have perused both the orders. There are concurrent findings of facts that the appellant has failed to prove its title to the suit property. The concurrent findings of facts are based on evidence.
We do not find any reason to admit the second appeal. Accordingly, the second appeal stands dismissed at the admission stage.
