Mr. Ramij Munsi ..for the petitioners Mr. Nilanjan Bhattacharjee, Sr. Standing Counsel Ms. Jayita Dhar Chakraborty Mr. Rhitam Chatterjee ..for the State The grievance of the petitioners is that the Assistant Engineer, Bansberia Highway Sub-Division-II has not taken any steps to remove the encroachment from the PWD road.

The learned advocate appearing for the petitioners, in his usual fairness, submits that during the pendency of this writ petition a letter under memo dated 9th July, 2025 has been issued by the said Assistant Engineer informing the petitioners that the site in question does not fall within the jurisdiction of the Assistant Engineer, Bansberia Highway Sub-Division-II.

In view of the subsequent events that cropped up during the pendency of this writ petition, the learned advocate appearing for the petitioners, on instructions prays for leave to file a comprehensive representation

before the appropriate authority praying for removal of unauthorised encroachment from the PWD road.

Such submission is not opposed by Mr.

Bhattacharjee, learned senior standing counsel. In the light of the submissions made by the learned advocate for the petitioners, WPA 14923 of 2025 stands disposed of by leaving the petitioners free to submit a representation before the appropriate authority ventilating their grievance with regard to alleged encroachment upon the PWD road. If such representation is submitted, the concerned authority shall consider the same and take steps in accordance with law as expeditiously as possible. The letter dated 9th July, 2025 is taken on record. There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
