1. Affidavit of service filed in Court today is taken on record.

2. The petitioner, as owner of the subject premises, let out the same to the West Bengal State Electricity Distribution Company Limited on rent.

3. Allegation of the petitioner is that the tenant is not paying rent to the petitioner.

4. Prayer has been made to direct the Authority to pay rent.

5. The Court is of the opinion that the dispute involved in the instant writ petition is of a private nature between the landlord and the tenant and the same does not have any public element involved in it.

6. The writ petition in the above facts and circumstances will not be maintainable.

7. The writ petition fails and is hereby dismissed.

8. It will be open for the petitioner to approach the competent forum for remedy, in accordance with law, if so advised.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
