Learned Advocate for the petitioner submits that the concerned Headmaster has forwarded all relevant papers to the concerned District Inspector of Schools, who in turn, forwarded the papers in connection with the petitioner's retiral benefits to the Director of Pension and Provident Fund. The Director of Pension and Provident Fund has raised a Memo dated April 19, 2022 wherein certain objections have been raised regarding the retiral benefits of the petitioner. Learned Advocate very fairly says that this furnishes the petitioner with a fresh cause of action and the petitioner has to challenge this Memo.

In view of the aforesaid, the contempt proceedings are closed. The Rule is discharged. The petitioner will be at

liberty to challenge the Memo dated April 19, 2022 in accordance with law before the appropriate forum. WPCRC 39 of 2022 is, accordingly, disposed of. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Arijit Banerjee, J.)
