AR(C) Mr. Anindya Bose Mr. Santanu Maji Mr. Mridul Biswas ...for the petitioners The petitioners are aggrieved by the exorbitant amount of property tax imposed in respect of flats no.5A and 5B on the fifth floor of the premises no.12A, Camac Street, Kolkata under the jurisdiction of Kolkata Municipal Corporation.

The petitioners applied before the Commissioner of the Corporation seeking benefit of waiver scheme. A representation dated July 4, 2022 (Annexure P6, p.71) filed by the petitioners is alleged to be kept pending before the concerned authority.

None represents the respondents. Affidavit of service is taken on record.

At present the waiver scheme is no longer available. The specific contention of the petitioner is that the similar flats in the same premises have been assessed differently and that the demand is far less than that of the petitioners.

As it appears that a proper representation objecting to the exorbitant demand is yet to be filed before the Corporation, accordingly, the instant writ petition is disposed of by granting leave to the petitioners

to file an appropriate representation highlighting their grievances before the Assessor Collector (South) of the Corporation.

If such representation is made, the same shall be considered by the aforesaid respondent in accordance with law after giving reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order. Steps shall be taken at the earliest.

The writ petition stands disposed of.

Certified copy of this order, if applied for, shall be made available to the parties.
