The revisional application has been preferred challenging an order dated 30.08.2024 being order No. 11 passed by the learned Judge, Special Court (POCSO), Basirhat in Special POCSO Case No. 62 of 2021 in connection with Baduria P.S. Case No. 695/2020 dated 01.12.2020 under Section 363/365 of the Indian Penal Code and adding Section 4 of the POCSO Act. 2.

Learned counsel for the petitioner submits that the petitioner herein was granted bail on 24.12.2021 by the trial Court. But now the trial Court has been pleased to issue warrant of arrest vide the order under challenge. It is submitted that it was for the 1st time the petitioner was not being represented and warrant of arrest has been issued.

As the revisional application is being disposed of, Ms. Puspita Saha, an empanelled lawyer of the State of West Bengal, present in Court being led by the learned Public Prosecutor, is appointed to represent the State in this case. Let their appointment be regularized by the appropriate authority. 4.

Considering the said facts and circumstances, the order dated 30.08.2024 is hereby stayed till the next date of appearance before the trial Court which appears to be in December, 2025.

It is made clear that in case the petitioner does not appear before the trial Court on the next date fixed for no reasonable explanation, the trial Court shall be at liberty to proceed in accordance with law.

CRR 2920 of 2025 stands disposed of.

Application, if any, stands disposed of.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
