Petitioners are working as primary teachers in their respective schools situated in two different districts. Petitioner no.1 is working in a primary school at Murshidabad and after the application made by the petitioner no.1 through District Primary School Counsel, Murshidabad being respondent no.7 and 8, the above respondent failed to forward the application to the West Bengal Board of Primary Education being respondent no.4 in this application.
In respect of petitioner no.2 the application made by the petitioner no.2 has already processed
and waiting disposal before the West Bengal Board of Primary Education.
It is submitted that both the petitioners are confirmed primary teachers and they have made application seeking mutual transfer..
The grievance of the petitioners is that the application pending before the Secretary, West Bengal Board of Primary Education being respondent no.4 but till date no decision is taken. The decision was not taken primarily because the District Primary Education Counsel, Murshidabad has not forwarded the same to the West Bengal Board of Primary Education.
On consideration of the submissions made on behalf of the parties and taking note of the documents placed before this Court, it appears that the mutual transfer application of the respondent no.2 is pending before the respondent no.4 and the application of the petitioner no.1 is pending before the District Primary School Counsel, Murshidabad. The District Primary School Counsel, Murshidabad is requested to forward the application of the petitioner no.1 to the West Bengal Board of Primary Education being the respondent no.4 herein and the respondent no.4 is requested to consider the application of the petitioners at an earliest preferably within eight weeks from the date of communication of this order
and the decision shall be communicated by fortnight thereto.
The Writ petition being WPA 14937 of 2025 is accordingly disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
