The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioner is the plaintiff of the connected suit for partition being Title Suit No. 85 of 2014 pending before the learned Civil Judge (Senior Division), at Diamond Harbour, District - 24 Parganas (South).

The petitioner is complaining delay in disposal of the said suit.

It appears from the record that few interlocutory applications are still pending. The learned Trial Judge felt that without taking evidence, some of those applications cannot be disposed of, as such, has decided to consider those applications along with the suit, for the disposal of the other interlocutory applications, date has already been fixed. The learned Trial Judge is therefore requested to dispose of the said applications as expeditiously as possible and after disposal of those applications, shall also proceed to dispose of the said suit expeditiously in accordance with law.

The learned Trial Judge, to adhere to the aforementioned direction, shall not entertain prayer of the parties for any unnecessary adjournment.

C.O. 2218 of 2024 is disposed of with the above terms without any order as to costs.
