31.8.2022 Sl.No.218 sn WPA 15541 of 2022 Gargi Mukherjee Vs.

The State of West Bengal & Ors.

Mr. Shamit Sanyal Mr. Priyakshi Banerjee Mr. Sabyasachi Roy ..for the petitioner Ms. Sipra Majumdar Ms. Sangeeta Roy ..for the State The petitioner alleges inaction of the Officerin-Charge, Parnasree Police Station. It is submitted that despite a complaint having been filed against the respondent no.8 about the derogatory and disrespectful statement against Lord Shiva, which hurt religious sentiments of a certain group of people; no steps were taken by the police authorities.

It appears that Hare Street Police Station Case No.156 of 2022 dated June 12, 2022 under Sections 153A/295A/505/120B of the Indian Penal Code, was registered against the respondent no.8.

However, the police report does not indicate what progress has been made in the investigation. It appears that the Face book post has been removed. As a case has been registered against the respondent no.8, this Court directs that the investigation must be completed expeditiously in a free, fair and impartial manner and all steps shall be

taken as authorised by law in order to unearth the truth. Justice must prevail.

As no affidavit in opposition has been filed, the allegations against the respondent no.8, are deemed to be denied.

The police authorities must conduct the investigation, as directed.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
