The specific case of the petitioner is that he was prevented and obstructed in filing the nomination papers. The police did not come to the aid of the petitioner so that he can file the nomination papers. The State Election Commission declared the dates of the Panchayat General Election, 2023 on 9th June, 2023. The last date of filing of nomination was 15th June, 2023.

The petitioner relies upon an order passed by this Court on 14th June, 2023 in WPA 13986 of 2023

wherein direction was passed in respect of one Md. Abdul Maleque Molla and others directing the Bhangar Police Station and Kashipur Police Station to render all assistance to the petitioners to file their nomination papers in course of the day or by the day after.

By today the final list of the contesting candidates has already been published. At this stage, there is hardly any scope to accept the prayer of the petitioner permitting him to file the nomination papers.

It will be open for the petitioner to approach the appropriate forum for redressal of his grievance in accordance with law, if so advised.

No relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
