CRR 2511 of 2022 In the matter of:- Souvik Das Mr. Apalak Basu ......for the petitioner Mr. N. Ahmed Md. Anwar Hosssain .....for the State Considering the exigency that the impugned proceeding has remained pending since 2015, the matter is taken up for hearing.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. The complaint was lodged by the private opposite party on 12.08.2015 leading to the registration of an FIR. A Charge sheet was submitted on 11.06.2018. There are eight witnesses mentioned in the charge sheet. A co-accused had absconded in the meantime, but she surrendered and obtained the bail subsequently. 23.09.2022 is fixed for framing of charge. The matter has remained pending for no fault of the present petitioner. No revision is pending before this Court in respect of the impugned proceeding. In the interest of justice this Court would be pleased to expedite the proceeding.

Learned counsel for the State submits that in the interest of justice a direction may be passed to expedite

the proceeding.

I have heard the submissions of the learned counsels appearing on behalf of parties and have perused the revision petition.

No prejudice will be caused to anyone if an order is passed in respect of the petitioner's prayer for expeditious disposal of the proceeding.

It appears that some delay has been occasioned in disposing the impugned proceeding, especially considering the fact that the FIR was lodged in 2015 and till date not even consideration of charges could take place.

In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charge on the next date fixed for hearing fixed for such purpose or within a month from such date.

With these observations, the revisional application is disposed of.
