Petitioner renews his prayer for bail and submits that he has been falsely implicated in the instant case. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record and keeping in mind the nature of allegations and as there is little progress in the matter since the last rejection of his prayer for bail, we are inclined to enlarge the petitioner on bail.
The prayer for bail is thus allowed.
Let the petitioners be released on bail upon furnishing a Bond of Rs. 10,000/- each, with two sureties of like amount each one of whom must be local, to the satisfaction of the Learned Chief Judicial Magistrate, Sealdah, subject to the condition that he shall appear before the learned trial court regularly on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall not enter the jurisdiction of Entally Police Station until further orders except for the purposes of investigation and/or for
attending the Court proceedings and shall provide the address where he shall presently reside to the Investigating Agency as well as the Court below and shall meet the Officer-in-charge of Entally Police Station once in a week until further orders.. In the event the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without any further reference to this Court.
