Ghosh Ms. Pritha Paul ...... for the State It is contended on behalf of the petitioner that there is delay in lodging F.I.R. It is also contended that the petitioner has been falsely implicated as he sided with the husband of the victim over their matrimonial dispute. He prays for bail. Learned lawyer for the State opposes the bail prayer. We have considered the materials on record. Statement of the victim implicates the petitioner in the offence of gang rape. Issue of false implication may be agitated in the course of trial. Victim is yet to be examined.

Hence, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, prayer for bail is rejected.
