Petitioner is aggrieved by the fact that after informing the police authorities cases were registered but no effective steps were taken. Subsequent to which final report 'mistake of facts' was submitted before the jurisdictional Court.

Report has been submitted by Mr. Datta, learned advocate appearing for the State and it has been contended that a Title Suit being T.S. 80/2022 has been preferred by the present petitioner which is pending before the learned Civil Court.

Grievance of the petitioner relates to padlock being affixed at the tenanted premises.

Having regard to the fact that the petitioner earlier approached the Civil Court, it would not be fit and proper

for the police authorities to establish the right of the petitioner so far as the property is concerned. However, since two cases were registered for investigation being Santipur Police Station case no. 205/2024 and Santipur Police Station case no.

1092/2024, I am of the view that in case the petitioner is dissatisfied with the outcome of the investigation, petitioner would ventilate his grievance under the statutory provisions of law before the jurisdictional Court. In case such an application is filed the Court would dispose of the application within a period of 60 days from the date of filing of the application.

With the aforesaid observations WPA 15078 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
