According to learned counsel, the Bank did not serve the notice to the petitioner under the relevant provisions of the SARFAESI Act, 2002 or the Rules framed thereunder.

Since there is no answer as to why the petitioner has not approached the statutory forum available to the petitioner under the SARFAESI Act, 2002, WPA 15562 of 2022 is dismissed without any order as to costs. (Moushumi Bhattacharya, J.)
