Petitioner is a student of B.Sc. (Honours) in Psychology in Asutosh College under the University of Calcutta. She cleared her Semester-I Examination in the year 2022.

As per prevalent practice, for Semester-II, her application was to be uploaded by the College on the portal of the University through online.

The College submits that an attempt was made to upload her application within the schedule fixed by the University, but due to technical defects, her application was not processed by the University. Only on July 8, 2022, on the University portal a list of candidates including the name of the petitioner, whose applications were kept pending, was published. Since there was no extension of time to upload the application, the College

could not submit the application again.

In such circumstances, College wrote a letter on July 13, 2022, requesting the University to permit the petitioner to sit in the Semester-II Examination. Mr.

Majumdar learned senior advocate representing the University on instruction submits that there was no attempt by the College to upload the form of the petitioner on or before 8th July 2022. Be that as it may, it is a question of the future of a student and the stand of the College makes it very clear that at least the petitioner was not at fault. In that view of the matter, without going into any controversy, I dispose of the writ application directing the University to permit the petitioner to write the Semester-II examination. The University will make an endeavour to issue the admit card in favour of the petitioner manually in course of this day. If it is not possible for the University to issue admit card in course of this day, the University will permit her to appear in the examination and issue admit card subsequently.

The College will deposit the necessary fees, if not already paid, in favour of the University through the State Bank of India within seven days from date. The controller of the examination of the University shall co-operate with the College and the petitioner to ensure that the petitioner can appear in the examination without further complication.
