Mr. T. Dutta .....For the Petitioner Mr. Dutta, learned counsel on behalf of the petitioner expressed his grievance regarding the order dated 29.03.2012 passed by learned Judicial Magistrate, 1st Court, Malda in Case No.45(M)/2010 under Section 125 of the Code of Criminal Procedure.

On perusal of the said order it reflects that the Court on an appreciation of the materials placed before it was pleased to award maintenance of Rs.3,000/- per month to the wife. Having regard to the quantum of maintenance which has been allowed and the reason so assigned by the learned Magistrate, I am of the view that the same do not call for any interference. However, the husband/petitioner will be at liberty to take out appropriate application if there are change of circumstances. Consequently, CRR 2185 of 2012 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
