The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioner is the plaintiff of a suit for partition being Title Suit No. 86 of 2018 pending before the 1st Court of learned Civil Judge, (Senior Division) at Contai, District - Purba Medinipore.

The petitioner by the present application is praying a direction upon the learned Trial Judge for expeditious disposal of the said suit within a specific time.

It appears from the record that the learned Trial Judge fixing dates for acceptance of the written statement of defendant nos. 1 to 4 subject to payment of costs. At this stage the direction as prayed for is not warranted. However, it is expected that the learned Trial Judge shall proceed to dispose of the said suit expeditiously in accordance with law without

entertaining the prayer of the parties for any unnecessary adjournment.

C.O. 1783 of 2021 is disposed of with the above observation without any order as to costs.
