Dipankar Mallick v. State Of West Bengal
IN THE HIGH COURT AT CALCUTTA
Criminal Revisional Jurisdiction 12-07-2023 Subha Item no. 03 Ct no.34 CRR 2531 of 2022 Dipankar Mallick -versus- State of West Bengal Mr. Mrinmoy Nandy ....for the petitioner.
Mr. Arijit Ganguly Mrs. Debjani Sahu ....for the State.
Petitioner is directed to serve a copy of the revisional application upon Mrs. Debjani Sahu, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Earlier, the revisional application was listed on 6th June, 2023 when none appeared on behalf of the petitioner. Today, when the matter has been called, learned advocate appearing for the petitioner prays for an accommodation.
Record of this revisional application reflects that in a case of Foreigners Act, warrant of arrest was issued and the same is pending since 21st June, 2022.
Having regard to the provisions of the Act under which the learned District and Sessions Judge, 2nd Court, Barasat did not interfere in Sessions Case No. 183 of 2021, I am of the opinion that
there is no illegality in the impugned order. Accordingly, the present revisional application being CRR 2531 of 2022 is dismissed.
Pending applications, if any, are consequently dismissed. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. Urgent Photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. [Tirthankar Ghosh, J]
