The petitioners are not represented at the time of call.

Mr. Sen, learned advocate appearing for the alleged contemnors, submits that, in order to comply with the order dated July 31, 2024, various correspondences were exchanged among different officials of the State. Ultimately, the Joint Secretary to the Government of West Bengal, Panchayat and Rural Development Department, by a communication dated

May 16, 2025, addressed the District Magistrate, inter alia, as follows:

"In this connection, I am further directed to draw your kind attention to clause (x) & (xii) Finance (Audit) Department Memo No.9008-F(P) dated 16.09.2011 and to mention that casual /daily rated /contractual workers, who have been engaged within 01.04.2010 in any sanctioned vacant post of various establishments of the Government for not less than 10 years continuously and have rendered service for at least 240 days each year will come under the purview of the said Memo of Finance (Audit ) Department.

From your letter it appears that Sri Haripada Das and Md. Motiur Rahaman were engaged under the Sakshar Bharat Mission, a centrally sponsored scheme, which continued till 31.03.2018. The scheme was related to the Mass Education Extension and Library Services Department, Govt. of West Bengal. Thus, it is clear that the said persons were not engaged against any sanctioned vacant post of this Department.

Accordingly, I am directed to request you to take up the instant matter with the Mass Education Extension and Library Services Department, Govt. of West Bengal."

In view of the aforesaid, there appears to be no justification to keep this writ petition pending. The petitioner shall, however, be at liberty to take appropriate steps in terms of the communication dated May 16, 2025, in accordance with law.

Let a copy of the letter dated May 16, 2025, be communicated to the petitioners by the State.

With the above observation, CPAN 1182 of 2025 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
