The revisional application was preferred challenging the proceedings under Sections 500, 501, 502 of the Indian Penal Code in C.R. No.269 of 2009 pending before the Learned Judicial Magistrate, 5th Court, Hooghly.
Record reflects that the stage at which the petitioner approached this Court was examination under Section 251 of the Code of Criminal Procedure being completed and dates were fixed for evidence.
Having regard to the contentions so advanced by the petitioner which are question of facts. I am not inclined to interfere. Records of the revisional application reflects that the interim order was till 26th November, 2012 the same was thereafter never extended.
Considering the aforesaid observations, no interference is warranted at this stage after nine years.
Consequently, CRR 2187 of 2012 is dismissed.
Interim order, if any, is hereby vacated.
All pending connected applications, if any, are consequently disposed of.
